Terms of Service

These Terms of Service govern your use of the BitPalm Agent Platform, operated by Bitpalm Computer Systems & Communication Equipment Software Design LLC. By creating an account, you agree to these terms in full.

Payments are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. Your payment information is handled directly by Stripe and never stored on our servers.

You may use the platform to create AI-powered chatbots for legitimate business purposes such as customer support, sales assistance, appointment booking, and information provision.

The following uses are strictly prohibited:

• Creating agents that generate, promote, or facilitate illegal content or activities
• Using agents for harassment, hate speech, discrimination, or threats
• Generating sexually explicit, violent, or otherwise harmful content
• Impersonating individuals, organizations, or government entities
• Distributing malware, phishing, or engaging in fraud
• Circumventing safety filters or content moderation measures
• Collecting personal data without proper consent or legal basis

You retain all rights to the content you upload to the platform, including training materials, documents, and knowledge base data. BitPalm does not claim ownership over your content or the AI agents you create. However, you grant BitPalm a limited, non-exclusive license to use your content solely for the purpose of providing and improving the platform services. BitPalm retains all rights to the platform software, design, and underlying technology.

The platform relies on third-party AI providers (including Google Gemini and other large language model providers) to power agent responses. By using the platform, you acknowledge that your agent configurations and end-user conversations may be processed by these providers in accordance with their respective terms of service and data processing agreements. BitPalm is not responsible for changes to third-party AI provider policies or service availability.

Each subscription plan includes specific usage limits such as number of agents, messages, knowledge base size, and available features. These limits are described on our pricing page. BitPalm reserves the right to enforce fair-use policies and to throttle or suspend accounts that exceed their plan limits or engage in abusive usage patterns.

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. BitPalm does not warrant that the service will be uninterrupted, error-free, or secure at all times.

You are solely responsible for the content generated by your AI agents and for ensuring compliance with all applicable laws and regulations. BitPalm provides the platform infrastructure but does not assume liability for the output of customer-configured agents. To the maximum extent permitted by law, BitPalm's total liability for any claims arising from or related to your use of the platform shall not exceed the total amount you have paid to BitPalm in the twelve (12) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless BitPalm, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your violation of these Terms of Service, or your violation of any rights of a third party.

BitPalm employs automated safety filters to prevent harmful content generation. Repeated violations of content policies will be flagged and may result in account suspension or termination.

BitPalm reserves the right to suspend or terminate accounts that violate these Terms of Service, with or without prior notice. In case of severe violations, termination may be immediate and without refund. You may cancel your subscription at any time from your billing page. Upon cancellation, your account remains active until the end of the current billing period. After termination or expiration, BitPalm will delete your data within 30 days, unless retention is required by law.

BitPalm processes data in accordance with GDPR and applicable data protection laws. All data is hosted on EU-based servers. For details, see our Privacy Policy.

AI-generated responses may contain inaccuracies, outdated information, or errors. BitPalm does not guarantee the accuracy, completeness, or reliability of any content generated by AI agents. You are responsible for reviewing and verifying AI-generated output before relying on it for business decisions, customer communications, or any other purpose. BitPalm is not liable for damages arising from incorrect or misleading AI-generated content.

BitPalm offers a free plan with limited features and usage. Demo accounts created through the website are temporary, subject to usage limits (including message caps and crawl limits), and are automatically deleted after 24 hours. Demo accounts carry no expectation of data retention or service availability.

BitPalm strives for high availability but does not guarantee any specific uptime percentage. There is no Service Level Agreement (SLA) included with any plan. Scheduled maintenance, infrastructure updates, or third-party outages may temporarily affect service availability. BitPalm will make reasonable efforts to notify users of planned downtime in advance.

Upon account deletion or subscription expiration, BitPalm will permanently delete all associated data within 30 days. This includes AI agent configurations, uploaded knowledge base files, conversation histories, captured leads, visitor data, analytics, and any other content stored on the platform. Deletion is irreversible. Data required for legal or regulatory compliance may be retained for the legally mandated period.

The BitPalm widget collects visitor data including page views, session duration, browsing behavior, and information voluntarily provided through chat conversations. As the account holder, you are solely responsible for informing your website visitors about this data collection, obtaining any required consent (including cookie consent where applicable), and complying with all applicable privacy laws such as GDPR, CCPA, or local equivalents. BitPalm provides opt-out functionality that you can enable, but the legal obligation to ensure proper disclosure and consent rests with you.

You may not resell, sublicense, or redistribute access to the BitPalm platform or any of its features without prior written consent from BitPalm. Creating accounts on behalf of third parties for commercial resale purposes is prohibited. If you are an agency or consultant managing chatbots for clients, please contact us to discuss partnership arrangements.

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the intent of the original.

BitPalm may update these terms at any time. Users will be notified of material changes via email. Continued use of the platform after changes constitutes acceptance.
